Terms of Service

The terms for using OrcaStrate to plan events, share wishlists and collaborate with friends and family.

Last updated October 22, 2026

1. About these terms

These Terms of Service govern your use of OrcaStrate, operated under the name OrcaStrate in California, United States (“OrcaStrate,” “we,” “us”). Contact us at support@orcastrateapp.com. Our Privacy Policy explains how we handle personal information.

By accessing or using the service, you agree to these terms. If you do not agree, do not use it. You must be at least 18 years old to create an account. If you use the service for an organization, you must have authority to accept these terms for it.

2. What OrcaStrate provides

OrcaStrate provides tools for planning events, birthdays, holidays, gift exchanges and other gatherings. Features may include collaborative idea boards, tasks, voting, invitations, RSVPs, wishlists, gift suggestions, people connections and vision boards.

We are not an event organizer, retailer, payment processor or escrow service. You are responsible for your events, arrangements, purchases and interactions with other people. Features may change, and we do not promise uninterrupted availability or that every feature will remain available.

3. Accounts and security

Provide accurate account information, protect your sign-in credentials and tell us promptly if you suspect unauthorized access. Do not impersonate someone else, share access without authorization or create accounts to evade restrictions.

Authentication is provided through Clerk and available sign-in providers, such as Google. Those services have their own terms. You remain responsible for activity you authorize through your account.

4. Sharing, invitations and gift surprises

Share event, invitation, vision-board and wishlist links only with people you intend to grant access to. A recipient may forward a link or copy information they can view. Some links provide access without an account, while other actions require sign-in. Do not treat a shareable link as a guarantee that information will remain confidential.

People search is opt-in. Friends and Family labels are personal organizational labels; a connection does not automatically grant event or wishlist access. Hosts and authorized participants control collaboration according to their permissions.

Gift reservations and purchase markers are user-reported. OrcaStrate hides shared-wishlist gift-giver statuses from the wishlist owner’s account, but cannot prevent someone from revealing a surprise outside the service or guarantee that a marked gift was purchased. Retailer clicks do not automatically confirm purchases. Wishlist items copied to an event are separate from the original list.

5. Your content and permissions

You retain your rights in content you submit, including text, photos, boards and wishlists. You grant OrcaStrate a non-exclusive, worldwide, royalty-free license to host, store, copy, display and process that content only as reasonably needed to operate, secure and provide the service and the sharing you request.

You must have permission to upload or share content and other people’s information. Do not upload sensitive identification, financial, medical or other information that the planning tools are not designed to handle. Respect copyright, privacy and the rights of others.

You can remove content using available controls or contact support. Shared copies, recipients’ downloads, backups and records required for legitimate legal or security purposes may not disappear immediately when you delete the original.

6. Acceptable use

Do not use OrcaStrate for unlawful activity, fraud, harassment, threats, exploitation, spam, infringement or content that violates another person’s privacy. Do not send invitations without a legitimate relationship or appropriate permission.

Do not bypass access controls, probe private data, interfere with the service, distribute malware, misuse sharing links or perform abusive automated collection. Security research must not access other users’ information or disrupt the service; report concerns to support@orcastrateapp.com.

We may restrict access or remove content reasonably necessary to address violations, security risks, legal obligations or harm to others.

7. Retailers, prices and affiliate links

Product links take you to independent retailers such as Amazon, Target, Walmart and Etsy. Any purchase is between you and the retailer and is governed by its checkout terms, shipping, returns, warranties and privacy policy.

Product information, images, availability and prices may change or be incomplete. A displayed price is not a guaranteed checkout price; confirm details on the retailer’s website. A recommendation is not a warranty or endorsement of safety, quality or suitability.

Some outbound links include affiliate tracking, and OrcaStrate may earn a commission on qualifying purchases. As an Amazon Associate, OrcaStrate earns from qualifying purchases. Affiliate programs determine eligibility and commissions. We do not promise that a click or purchase will qualify.

8. Fees

The current consumer event-planning and wishlist service does not collect retailer payments or pool gift money. If we introduce paid OrcaStrate features, we will disclose the price and applicable billing, cancellation and refund terms before you choose to purchase them. These terms do not authorize undisclosed charges.

9. OrcaStrate intellectual property

Except for user content and third-party materials, rights in OrcaStrate’s software, branding and service materials belong to their respective rights holders. These terms permit ordinary use of the service, not resale, impersonation or unauthorized copying of our branding.

10. Ending your use and deleting data

You may stop using OrcaStrate at any time. Settings includes data export and deletion controls. Deleting planning data is not necessarily deletion of your authentication account; contact support@orcastrateapp.com if you also want the sign-in account removed.

We may suspend or terminate access for material violations, security concerns or legal requirements. Where reasonably practicable, we will explain the restriction. Provisions intended to survive termination, including ownership, disclaimers and dispute terms, continue to apply.

11. Disclaimers and limits of liability

To the extent permitted by law, the service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee error-free operation, data recovery, event outcomes or the conduct of other users and retailers.

To the extent permitted by law, OrcaStrate is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data arising from use of the service. Our aggregate liability for a claim relating to the service is limited to the greater of US $100 or fees you paid OrcaStrate for the service in the 12 months before the event giving rise to the claim.

These limitations do not exclude liability that cannot lawfully be excluded, including applicable liability for fraud, willful misconduct or gross negligence. Nothing in these terms limits mandatory consumer rights.

12. Governing law and disputes

California law governs these terms, excluding conflict-of-law rules, except where your local law requires otherwise. Please contact support@orcastrateapp.com first so we can try to resolve a concern. Nothing here requires arbitration, waives a jury trial or prevents you from using a competent court or regulator.

13. Changes and contact

We may update these terms as the service or legal requirements change. We will update the date on this page and provide reasonable notice of material changes through the service or available contact information. Changes will not retroactively remove rights you already have.

Questions, legal notices, copyright concerns and complaints can be sent to support@orcastrateapp.com. If a provision is unenforceable, the remaining terms remain effective to the extent permitted by law.
